Care Association (NCA) welcomes the House of Lords Judgement
NCA has
today welcomed the decision of the law lords to reject the claim that
care homes should be considered to be statutory bodies within the
context of the Human Rights Convention.
Sheila
Scott OBE, Chief Executive of NCA said today: “ NCA and its legal team
at Lester Aldridge have always believed that Care Home residents have
absolute protection within British Common Law. The Human Rights
Convention applies to government both Nationally and Locally to protect
people against abuse by the State.
More
than 70% of Care Homes in the UK are owned by small private business and
inappropriate attempts to treat them like government bodies would have
placed their future in jeopardy.”
NCA
is pleased to note that common sense has prevailed in the UK and that
this will draw the matter to a close.
